1. Who publishes and who is responsible

The account holder decides on and authorizes their publications. They must be qualified to conduct their business, have their brokerage’s authorization where required, and accurately display their professional identity. An independent account does not remove supervision or obligations to their broker. Use of the term REALTOR® or other professional trademarks requires the corresponding rights; a real estate license does not automatically grant trademark rights.

Startit provides infrastructure and software controls, not a license to advertise properties, a legal opinion or representation of buyers or sellers. The agent is responsible for their statements and instructions to the extent legally attributable to them. Startit retains its own legal obligations and may investigate or remove content under these terms.

2. Verifiable source and authorization

Before publishing a property, identify its source, the responsible brokerage and the person authorizing publication. Keep sufficient, legible evidence of the authorization, its scope, restrictions and validity period; a unilateral statement or a screenshot of a public listing does not replace a required permission. If an MLS, provider, listing broker or rights holder is involved, also check their contracts and terms. Private access to data does not authorize its redistribution.

Record permitted channels separately: website, private portal, email and push. Respect restrictions on addresses, images, data, attribution, time limits, territory and removal. Authorization must cover each actual use. When it expires, is revoked or circumstances change, update the record and immediately discontinue unauthorized uses. Do not rely exclusively on an automated process to meet a contractual deadline.

Evidence is stored privately. Minimize personal information unrelated to the permission and do not upload unlawfully obtained documents. Fabricated evidence and demonstration authorizations are not permitted for real inventory. The platform may block publication if information is missing, a restriction applies or an administrative takedown is in place.

3. Photographs, text and generated content

Check rights to photographs, videos, floor plans, maps, text, logos, portraits, testimonials and other materials separately from authorization to advertise the property. Purchasing a photograph or crediting its author does not always permit every necessary channel, edit or sublicense. Keep the applicable licenses, assignments and consents, including image and trademark rights.

Review every AI-generated result. Do not invent testimonials, sales, credentials, views or features. Identify visualizations, virtual staging, illustrative images and samples when omitting that information could mislead, and comply with applicable provider and advertising rules. Do not present a stock image as an authentic photograph of a property.

4. Accuracy, brokerage identification and equal treatment

Verify price, availability, the address permitted for disclosure, area, features, dates, contact details and other relevant claims. Display the brokerage’s legal name alongside contact information and any identifiers or disclosures required in your jurisdiction. In Florida, brokerage identification must comply with applicable electronic advertising rules. A disclaimer hidden in the footer does not correct a false or misleading claim in a listing; place relevant clarifications clearly and close to the claim, including on mobile devices.

Comply with fair housing rules and do not publish preferences, exclusions or discriminatory messages based on characteristics protected by federal, state or local law. Use objective real estate criteria and also review targeting, images and text proposed by AI. Equal opportunity notices do not legitimize discriminatory practices. Do not include confidential information, property access instructions or personal data without authorization.

5. External links, reminders and recipients

A link to FlexMLS or another provider opens the destination service under its own terms. You must be authorized to share the link and respect access controls, expiration and privacy. Knowing a URL does not permit copying the provider’s catalog, photographs or data. Startit does not inspect the catalog to detect changes and does not claim that new results are available: reminders follow the configured frequency and schedule.

Sharing a resource does not replace the consent or legal basis required to contact its recipient. Respect opt-outs, authorized channels and quiet hours. Campaigns must identify the sender and include any required disclosures, postal address and opt-out options. A delivery accepted by a provider does not establish actual receipt or reading.

6. Custom designs and review before publication

Office custom designs are built using the supported safe schema. Review the preview at different sizes and check text, links, images, contrast, readability and disclosures. Do not remove professional identification or required legal information, and do not use free-form sections to bypass property rights controls. Dynamic data remains subject to account and publication restrictions.

Publication confirmation is recorded for the specific operation and is not an indefinite permission. Technical or administrative approval confirms a platform step; it does not establish legality, ownership or brokerage approval. You must retain evidence and address changes after publication.

7. Notices, restrictions and review

Report unauthorized uses, inaccurate information or unlawful content to info@startitservices.com, providing the URL, reason and sufficient evidence. Do not include passwords or unnecessary sensitive documents. Rights complaints also follow the content and intellectual property procedure.

Startit may temporarily restrict a resource, request clarification, preserve evidence and remove content in response to a substantiated complaint, expiration, revocation, valid order or security risk. When lawful and safe, it will notify the agent and allow documentation to be submitted for review. Failure to remove content immediately does not imply authorization; removal does not finally determine rights between the parties. Repeated violations or attempts to bypass controls may result in proportionate suspension or closure.

8. Scope of responsibility

The responsibility, defense of claims and limitation provisions of the Terms of service apply, subject to the exceptions and non-waivable rights specified there. This policy does not promise immunity, authorize publication without rights or exempt Startit from its own acts or obligations. The agent must obtain professional advice when required by their activities, territory or contract.
